My client took out life insurance policy on her son. Her son was tragically murdered some several months after the policy had been effective. Her life insurance carrier denied the claim, asserting that there might be preexisting conditions that would nullify the policy.
You won’t be surprised to hear that I filed a lawsuit against the Life Insurance carrier for breach of contract. I can’t wait to see how they prove that a preexisting condition is possible in a homicide case.
These are typical flat denials we are seeing all the time. As with most of my insurance cases, if I am successful, the insurance company will be required to pay my hourly fees and costs, and if I lose, I’ll work for free.
